Open Space and Lake Access Agreement

  1. Open Space and Lake Access Agreement

    This form will be used when construction will be completed public open space including the lake and within the lake property lines OR in the event access to another area through the City of Chestermere property is needed.

    Once your application is submitted, a Parks Coordinator will be in contact with you within 5 business days of submission.

    Inspections are completed during regular business hours Monday – Friday (excluding Statutory Holidays) between 8:00 am - 3:30 pm.

    Please Note: The Pre-Inspection, Construction and Final Inspection steps will be completed after your application is reviewed by our team.

  2. Application Process

    Submit Application 

    • Submit form online
    • Expect 5 business days for emailed approval.
    • Contact Community Operations for initial inspection details. (24 hours notice). 
    • Tree protection plan (if needed).
    • Sign the Waiver of Liability and Release.

    Pre-Inspection

    • Meet the inspector onsite to go over the plan.
    • Sign off on existing conditions of area.
    • Ensure safety and tree protection plans are in place
    • Sign pre-inspection details.

    Construction

    • Keep public areas safe and tidy.
    • Repair damaged areas.
    • Contact Community Operations for final inspection details (24 hours notice).
    • Ensure the establishment of new plantings. (seed / sod). 

    Final Inspection

    • Meet Inspector onsite to go over the plan.
    • Sign off on existing conditions of the area.
    • Sign final acceptance.

  10. Waiver of Liability and Release

    I am in full recognition and appreciation of the potential damages to the City of Chestermere property, do hereby waive, release and forever discharge The City of Chestermere, its officers, agents and employees from and against any and all claims, demands, action or causes of action for costs, expenses or damages to personal property or personal injury, or death, which may result from my use of this area.

    I understand and admit my use of the area noted above is voluntary and that I am only eligible for use of the space for the time outlined above. 

    I assume full responsibility for any injuries or damages resulting from my use of the property including the responsibility for using reasonable judgement in all phases of the park or city property. I recognize and understand that my participation is solely at my own risk and that I assume full responsibility for any resulting injuries or damages. Should any damages occur, they will be repaired at my cost to the satisfaction of the City of Chestermere Parks Department. I also understand that this WAIVER OF LIABILITY and RELEASE binds my heirs, executors, administrators and assigns as well as myself. 

    I acknowledge that I have read and understand this entire WAIVER OF LIABILITY AND RELEASE, and I AGREE to be legally bound by it.

  13. Remediation Expectations & Details

    A complete list of trees and shrubs, irrigation system requirements, plant material and park amenities to be replaced must comply with the City of Chestermere’s Landscape Standards and Specifications

    Irrigation System

    • Contractors are expected to repair the irrigation system. Visual inspection(s) of repairs must be done prior to covering up the work. 

    Trees 

    • The minimum size for deciduous trees is a 15-gallon pot and evergreen trees are 2.5 meters tall. Tree pits to be 2 times the diameter of pot/rootball and backfill with a high-quality planting mix. All trees must be mulched. 

    Shrub Beds and Plant Material: 

    • Shrubs and plant material must be replaced to their original material and of acceptable maturity. Remedial work must also address the remediation of soil, replacement of mulch (6 inches), completion of edging, etc. 

    Turf: 

    • Irrigated, manicured parks will be rehabilitated using sod (#1 Kentucky Blue Grass sod) and watered thoroughly on a daily basis for a minimum of 2 weeks and until establishment. 
    • Sites that are not irrigated will be approved and handled on a site-by-site basis. In some situations, hydroseeding may be considered (Urban B grass seed, application of no less than 30 g/m2 or 300 kg/ha). Final approval will be given at a minimum of 80% establishment. 
    • During the maintenance period, weeds must be kept to a minimum to ensure that grass seed has a chance to establish. All turf must be maintained until it is back to its original state. 

    Other: 

    • Asphalt and gravel pathways, stonework, general surfaces, berms, creek beds, fences, roadways, concrete work, curbing, and other park amenities must be replaced according to the City’s Landscape Standards and Specifications, or repaired to an equivalent level. Patching of surfacing must be done in 1 metre sections.
